A Guide to Florida Pre-Employment Background Check Laws​

What are Florida background check and ban-the-box laws?

At this time, there are no Statewide ban-the-box or fair hiring laws in the State of Florida that supplement the background check in Florida provisions of the FCRA, or impose any additional restrictions. With some specific exceptions, the State, moreover, is not permitted to disqualify for employment with the State.

Nor prohibited from practicing, pursuing, or engaging in any occupation, trade, vocation, profession, or business for which a license, permit, or certificate is required to be issued by the State. Any applicants who have had a prior criminal conviction or Florida court record arrest records (including marijuana use), had a non-annulled criminal conviction, or had their civil rights restored.

This Florida criminal history record check and criminal background record restriction applies to employment by the State, any of its agencies, or political subdivisions.

Cities Include: Jacksonville, Miami, Tampa, Orlando, St. Petersburg, Hialeah, Tallahassee, Port St. Lucie, Fort Lauderdale, Cape Coral and more.
