At this time, there are no Statewide ban-the-box or fair hiring laws in the State of Florida that supplement the background check provisions of the FCRA, or impose any additional restrictions. With some specific exceptions, the State, moreover, is not permitted to disqualify for employment with the State, nor prohibited from practicing, pursuing, or engaging in any occupation, trade, vocation, profession, or business for which a license, permit, or certificate is required to be issued by the State, any applicants who have had a prior criminal conviction (including marijuana use), had a non-annulled criminal conviction, or had their civil rights restored.
This restriction applies to employment by the State, any of its agencies, or political subdivisions.
