Michigan Background Check & Pre-Employment Laws

What are Michigan background check and ban-the-box laws?

Although Michigan CRAs are allowed to report felony charges from background checks in Michigan that have not yet been adjudicated by conviction or dismissal, employers are prohibited from requesting, assembling, or maintaining information on job applicant arrests, detentions, or dispositions for misdemeanor arrests that did not result in convictions pre employment.

In addition, State and local government employers are prohibited from inquiring about a job applicant’s salary history, per Executive Directive 2019-10.

What About Social Media Background Checks In Michigan?

Regarding the use of social media in background checks, unless there are employee misconduct or investigations underway, an employer cannot request user names or passwords for an applicant/employee personal website or social media account.
