South Carolina Background Check Laws​

What are South Carolina’s  background check and ban-the-box laws?

South Carolina has no statewide fair hiring, second chance, or Ban the Box laws to supplement the FCRA at this time.

On June 4, 2019, the County Council of Richland County, SC took action to approve a Ban the Box rule. Prior to that, only York County, SC had such a resolution on the books, dating from January 2017.

Although the city of Columbia, SC already had implemented an unofficial Ban the Box policy three years ago, in mid-August 2019 the Columbia City Council made history as the first municipality in SC to pass an ordinance prohibiting any city employer, and any vendor contracting with the city, from asking about a job applicant’s criminal records or wage history during the pre-employment process. Background checks may only be requested after a conditional offer of employment.
