Texas Pre-Employment Background Check Laws

What are Texas background check and ban-the-box laws?

Texas passed its own mini version of an FCRA statute for background checks in Texas in 1997 which limits consumer reporting agencies from reporting felonies and misdemeanors for Texas criminal background checks older than 7 years. Some consider this law invalid due to the fact it was passed after the federal FCRA, however many consumer reporting agencies follow this Texas law.

At this time, there are no Statewide ban-the-box or fair hiring laws for pre employment decisions in the State of Texas that supplement the background check provisions of the FCRA.

Cities Include: Houston, San Antonio, Dallas, Austin, Fort Worth, El Paso, Arlington, Corpus Christi, Plano, Laredo and more!
